Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the VocalMax platform (the “Service”). By creating an account or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation.
01The Service
VocalMax is a software platform for running automated outbound phone campaigns with AI voice agents. You upload contact lists, configure an AI agent, and the Service places calls on your behalf, transcribes them, classifies the outcome of each conversation, and provides reporting and notifications.
The Service is a tool. You decide who is called, when, and with what script, and you remain responsible for those decisions and for the content of your campaigns.
02Accounts
You must provide accurate account information and keep it up to date. You are responsible for all activity that occurs under your account and for keeping access to your account secure. Notify us promptly if you believe your account has been accessed without authorisation.
03Subscriptions, credits and billing
The Service is offered on a monthly or yearly subscription. Each plan includes a monthly credit allowance; yearly plans receive the full year's allowance up front. Credits are the unit of usage: one credit corresponds to approximately one minute of connected call time, and connected calls are billed by duration with a minimum of one credit per connected call.
Monthly subscriptions are charged in full when you subscribe and renew monthly. Yearly subscriptions begin with a 3-day free trial: a valid payment card is required to start, you may cancel at any time during the trial and will not be charged, and if you do not cancel, your paid subscription begins automatically when the trial ends and renews yearly. Cancellation stops future renewals and takes effect at the end of the current billing period.
No answer = no charge. Calls that do not connect — including no-answer, busy, and failed calls — do not consume credits. Where credits are reserved at the start of a call, they are automatically returned in full if the call does not connect, and adjusted to the actual connected duration if it does.
Credits are non-transferable. Subscription fees and any purchased top-up credits are non-refundable except where required by law. Credits included with a monthly plan carry no cash value.
04Acceptable use
You must use the Service lawfully. In particular, you must comply with all telemarketing, robocall, and telecommunications laws and regulations that apply in the jurisdictions you call — including, where applicable, rules on automated and prerecorded or artificial-voice calls, calling-hour restrictions, and caller identification requirements.
You agree that you will:
- only call individuals from whom you have obtained any consent required by applicable law for automated or AI-voice calls;
- honour do-not-call requests promptly, maintain your do-not-call list within the Service, and screen against applicable statutory do-not-call registries where required;
- not use the Service for fraud, harassment, deception, or impersonation;
- not misrepresent who is calling or why, and identify the nature of the call where the law requires it.
We may suspend or terminate accounts that violate this section. You are solely responsible for legal compliance of your campaigns, and you agree to indemnify us against claims arising from your calling activity.
05Your data
You own the data you bring to the Service — your lead lists, contact details, scripts, and the transcripts and recordings generated from your campaigns. We process that data only to provide the Service to you, including AI-powered transcription and classification, and we do not sell it.
You are responsible for having a lawful basis to upload and process the personal data in your lead lists. On account closure, you may request deletion of your data.
06Availability and third-party services
The Service depends on third-party telephony, AI, and infrastructure providers. We work to keep the Service available and reliable, but it is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that calls will connect, that transcription or classification will be error-free, or that the Service will be uninterrupted.
07Limitation of liability
To the maximum extent permitted by law, VocalMax and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or business opportunities, arising out of or relating to the Service.
To the maximum extent permitted by law, our total aggregate liability for all claims relating to the Service is limited to the amount you paid for credits in the twelve months preceding the event giving rise to the claim.
08Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if your use creates risk or legal exposure for us. Sections that by their nature should survive termination — including acceptable use responsibility, data ownership, and limitation of liability — survive.
09Changes to these Terms
We may update these Terms from time to time. When we make material changes we will update the “Last updated” date above and, where the change is significant, take reasonable steps to notify you. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
